Weed infraction or misdemeanor in California if I got the ticket on Nov 3rd but have trial after Jan 1st?

I got pulled over for having weed in my car on Nov 3rd, 23222(b)vc, which was labeled as a misdemeanor. On Oct 1st, Arnold signed for it to be an infraction but it doesn't take effect until Jan 1st 2011. If I am not declared guilty until after that date will it be an infraction or a misdemeanor?
